Acceptable Use Policy
Guidelines for the professional and lawful use of the Totalsoft platform.
1. Purpose
This Acceptable Use Policy (“AUP”) forms part of our Terms of Service and sets out the rules for using the Totalsoft platform. Breach of this AUP is a material breach of the Terms of Service.
2. Prohibited activities
You may use the platform only for lawful purposes. You must not use it:
- In any way that breaches applicable local, national, or international law or regulation.
- In any way that is fraudulent or has a fraudulent purpose or effect.
- To transmit unsolicited or unauthorised advertising or promotional material other than in accordance with clause 3 below.
- To knowingly transmit or upload any material containing viruses, malware, or other harmful code.
3. Customer communications (SMS and email)
Where you use the Service to send SMS or email communications to your customers (for example, booking confirmations or MOT/service reminders), you are responsible for complying with the Privacy and Electronic Communications Regulations (PECR) and UK GDPR as they apply to those communications — including having an appropriate lawful basis to contact each customer, not sending communications to individuals who have opted out or withdrawn consent, and ensuring the content is accurate and not harassing, threatening, or abusive.
We provide unsubscribe/opt-out mechanisms on reminder emails; you must not attempt to circumvent them or re-contact a customer who has opted out through another channel on the platform.
We may suspend your ability to send communications through the Service if we reasonably believe you are in breach of this clause, to protect our email/SMS sending reputation and other customers of the platform.
4. System integrity and fair use
You agree not to:
- Reproduce, duplicate, copy, or resell any part of the platform except as expressly permitted by the Terms of Service.
- Access without authority, interfere with, damage, or disrupt any part of the platform, the equipment on which it runs, or any network connected to it.
- Attempt to circumvent security measures, or gain unauthorised access to other users’ accounts or data.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent this restriction is not permitted by law.
- Use automated means to extract data from the Service at a volume or frequency that we reasonably consider abusive of shared infrastructure.
5. Content standards
Any content you upload to the platform (customer records, service descriptions, notes, photos) must be accurate where it states facts, must comply with applicable law, and must not infringe a third party’s rights (including data protection and intellectual property rights).
6. Enforcement
Breach of this AUP may result in a warning, temporary or permanent suspension of your account or specific features (such as SMS/email sending), removal of offending content, or termination of your subscription under the Terms of Service, proportionate to the breach. We will act reasonably and, save where urgent action is needed to protect the platform or other users, will give you an opportunity to remedy a breach before suspending or terminating.
